User's responsibility
The user shall be responsible for the illegality of any text, information, image, program, or multimedia content and data transferred over the network through service, with expressed waiver of OverTV Italia S.r.l. and club owner offers internet connectivity from any liability and burden of proof and/or control in this regard. The user is also responsible for any illegal activity (such as, for example, spam, illegal interception of computer and/or communications telematics, infringement, misappropriation or deletion of electronic correspondence, communications offensive, abusive or defamatory, violating the privacy of other users of the network, etc.) held in the network through the use of the service.
Warranty and limitation of liability of OverTV Italia S.r.l.
Account of technological innovation of solution no warranty is given about the quality and performance of transmission lines, on functionality, quality and performance of activated links. You agree that OverTV Italia S.r.l. can stop the provision of the service to ensure the maintenance and extraordinary. Therefore, OverTV Italia S.r.l. and the club owner that provides internet connectivity will not be in any way liable to the user for the non-availability of service induced by an interruption, partial or total, of the service provided. OverTV Italia S.r.l. disclaims any liability arising from improper or illegitimate use, incorrect use of service covered by this agreement, by you or by third parties. OverTV Italia S.r.l. and the club owner that provides internet connectivity will not be responsible for both contractually and extracontrattualmente, of patrimonial and non, direct or indirect, including loss of profit or the failure to achieve savings, suffered by you or by third parties as a result: a) use or failure to use the INTERNET, even if it was aware of the possibility of the occurrence of the fact malicious; b) infringements, delays, interruptions, difficulty or impossibility, total or partial, of INTERNET connection. c) than any any other cause or circumstance, even if not expressly indicated, that is not dependent on the will of OverTV Italy S.r.l (unforeseeable circumstances or force majeure). On the INTERNET some services may contain text, images or generically data which may be offensive to common sense of decency, insulting, dishonour or reserved for adults only: the only makers are providers of this information and the user may freely decide whether access or not. Therefore the user lifts OverTV Italy S.r.l from any responsibility concerning the nature of the information accessible through the INTERNET. Any other responsibility of OverTV Italia S.r.l., for any reason whatsoever arising from the execution of this agreement, sussister only in cases of intent or gross negligence. Pursuant to Legislative Decree No. 70 of 2003, OverTV Italia S.r.l. è not in any case responsible for placing on the network, any text, information, image, program, or multimedia content, given (called hereafter content) contrary to public policy, morality and public or otherwise violative moralit, however, any rights of third parties arising by law, this agreement and/or custom (by way of example and not limited: copyright, privacy rights, rights of ownership intellectual and industrial). OverTV Italy S.r.l is not also responsible for placing content in child pornography, pornographic, obscene, blasphemous or defamatory. In compliance with the provisions relating to liability directive 00/31/EC transposed by Legislative Decree 70/2003, OverTV Italia S.r.l. may suspend all or part of the service which is the subject of this agreement, or disable access to content published by the User as soon as it is informed, on a communication from the competent authorities, of their illegality
Information on the processing of traffic data ex 13 art.li paragraph 123 and 4 of Legislative Decree No. 196 of 2003
Data about the user connection to the network OverTV Italia S.r.l. are treated electronically for purposes of billing, investigation and suppression of offences and subsequently for purposes of investigation and prosecution of crimes under art. 407, paragraph 2 (a)), as well as c.p.p. crimes against computer or telecommunications systems. Such treatments are carried out in compliance with the obligations laid down in art. 132 of Legislative Decree No. 196/2003 (as replaced by article 3 of the d. l. 24.12.2003 n. 345), adopting the security measures laid down in art. 31 of Legislative Decree No. 196/2003, and are limited to the following information: call ID, user ID, IP address, connection time, logoff time. Such information will be handled solely by a person in charge within the structure OverTV Italia S.r.l., will not be disclosed to any external entity except the request of the judicial authority and will be destroyed at the end of the period of compulsory storage provided for in the above-mentioned legal provisions. Data subject's rights, referred to in art. 7 of d.Lgs. 196/2003, you see this notice at the end of this agreement. The data controller is OverTV Italia S.r.l. headquartered in Foligno (PG)-Italy, Via g. Polanga 2, 06034.
Biodata conservation
Biographical data, data relating to the mobile number provided by users will be collected and stored by it, pursuant to Ministerial Decree of August 16, 2005.
Such data may be made available by OverTV Italia S.r.l. to request electronically, excluding however the contents of communications, postal and communications police, which organ of the Ministry of the Interior responsible for police services and communications, posatale and, in accordance with the code of criminal procedure, the judicial authorities and the police. Pursuant to art. 1 lit. B, no. 1) D.L. 2.10.2008 No. 151, bearing ' urgent measures with regard to the prevention and detection of crime, enforcement against organised crime and illegal immigration ', converted into law, with amendments, art. 1, par. 1 L. 28 November 2008 No. 186, OverTV Italy S.r.l will, in order to ensure the availability and effectiveness of the Protocol addresses to be unique, to keep the following data: the data necessary to trace and identify the source of a communication for the Internet access, and then: the name and address of the registered user to whom the communication was uniquely awarded the internet protocol address (IP) and the user ID; the data needed to determine the date, time and duration of a communication, such as the date and time (GMT) of the connection and disconnection of the internet access service, together with the IP address, dynamic or static, uniquely assigned by the Internet access provider to a communication and identification of the registered user. The user also not performing OverTV Italia S.r.l. any type of treatment on transmitted data after it is logged on to the network, accepts that he retains the full and exclusive ownership, within the meaning of art. 4 comma 1 letter f) and 28 of Legislative Decree No. 196 of 2003, personal data transmitted or received in connection with any Internet Protocol (such as http, https, ftp, nntp, smtp, pop). Therefore, you acknowledge that you are solely responsible for processing and in consequence of the adoption of all the necessary security measures for the protection of the data.
Logon credentials
The user undertakes to store credentials for network access OverTV Italia S.r.l., and to communicate without delay to the latter any loss and/or suspected of spreading or taking knowledge from unauthorized parties the password itself. The user is also aware that the identification of the person responsible for the traffic entered into the network through this connection is carried out based on the logon credentials.
Information on the processing of personal data pursuant to art. 13 of d. Lgs. n° 196 of 2003
Dear user, in relation to personal data, whose firm OverTV Italia S.r.l., 06034 Foligno (PG)-Via g. Polanga, P.IVA 02306380904, 2 enters into possession, we hereby inform you pursuant to article 13 of d.Lgs. 30/0672003 No. 196 code on personal data as follows.
The personal data supplied by you will be processed in paper and electronics exclusively for purposes related to:
- activation technique and technical management, service management and accounting services. The bestowal of the data is required.
- The obligations laid down by law, regulation, contractual provisions given by authorities legitimated by law and by supervisors and control
Your personal data will be processed for the purposes listed above, respecting the principles of lawfulness, fairness and transparency, by ensuring the full exercise of his rights, as specified under better.
The processing of your data will be processed in accordance with the procedures listed below, or by means of any operation or set of operations concerning the collection, recording, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, cancellation and destruction of data.
These operations may be carried out with manual mode and/or with the use of computer procedures to the above-mentioned purposes and by persons previously appointed to carry out the same treatment to ensure the security and confidentiality of data.
In case of failure to provide the requested data, it will not be possible to proceed with the network access and service activation.
The data will be processed solely by technical and administrative staff of OverTV Italia S.r.l. processor pursuant to art. 30 d. Lgs. n° 196 of 2003 and may possibly be communicated to business consultants engaged to OverTV Italia S.r.l.
Please note, also, that such data may be communicated or otherwise acquired by all those subjects whose data knowledge is indispensable for the fulfilment of obligations to our load. In particular, your personal information may be accessed by external collaborators (appointed by the proprietor as data controllers in outsourcing) and business owner that provides internet connectivity through the service 'Wi-Fi 4 Fre' within its premises.
Your personal data are not disseminated, therefore, will not be disclosed by us, even through their consultation or provision, in any form to indeterminate.
Your personal data may be possibly transferred to EU countries and/or towards third countries in relation to the European Union, exclusively, in the context of the purposes referred to above and in accordance with the requirements of law.
Pursuant to art. 7 of Legislative Decree No. 196 of 2003 the customer has the right to obtain confirmation of the existence or not of personal data concerning him/her, even if not yet recorded, and their communication in an intelligible.
The customer has the right to obtain the indication:
- the origin of the personal data;
- the purposes and methods of processing;
- the logic applied in case of treatment carried out with the aid of electronic instruments;
- indicative of the extremes of the holder, the responsible and the representative designated pursuant to art. 5, comma 2;
- of the subjects and categories of subjects to whom the personal data may be communicated or who may come to know it in their capacity as designated representative in the territory of the State, managers or agents.
The customer has the right to obtain:
- updating, rectification or, when interested, integration of data;
- the cancellation, transformation into anonymous form or blocking of data treated in violation of law, inclusive those of which not the maintenance is necessary in relationship to the purposes for which the data were collected or subsequently processed;
- certification that the operations as per letters a) and b) have been brought to knowledge, also as it regards their content, to those to whom the data were communicated or disseminated, except the case in which such fulfilment is impossible or involves a manifestly disproportionate to the protected right. The customer has the right to oppose, wholly or in part:
- on legitimate grounds, to the processing of personal data concerning him/her, even if pertinent to the purpose of collection;
- to the processing of personal data concerning him/her for the purpose of sending advertising materials or direct selling or for carrying out market surveys or commercial communication.

Commercial information
Given that the transfer of data (number of mobile phone users) for the purpose of sending SMS messages containing promotional and advertising is absolutely optional, I agree explicitly and I authorize you to send SMS messages containing promotional or advertising of subjects belonging to Wi-Fi 4 Free and/or third parties, without which they have, however, no access to the data provided. I agree also that the number of cellular users stocked by me to access WiFi service 4 Free, could be transferred to third parties for the purpose of sending SMS messages containing promotional or advertising by third parties. Treatment for promotional or advertising purposes may be revoked by you at any time via an e-mail to the following address unsubscribe@wi-fi4free.it.
